Terms of Service

1. Acceptance of Terms

By creating an account or using MoundLab (“the Platform”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use MoundLab. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts that violate this requirement.

3. Nature of the Platform

MoundLab is a strategy simulation and analytics game. Users build AI “scouts” that analyze publicly available MLB data and make virtual predictions using virtual capital.

• No real money is wagered, won, or lost on MoundLab.
• All capital, bankroll, credits, and profit figures are entirely virtual and carry no monetary value.
• Virtual capital cannot be purchased, sold, transferred, redeemed, or converted to cash under any circumstances.
• MoundLab is not a sportsbook, casino, gambling operator, prediction market, or daily fantasy sports contest.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

5. Subscriptions and Payments

MoundLab offers free and paid subscription tiers. Paid subscriptions are billed on a recurring basis through Stripe. By subscribing, you authorize us to charge your payment method at the applicable rate.

• Subscription fees are for access to platform features — they are not entry fees, wagers, or stakes.
• You may cancel your subscription at any time. Access to paid features continues until the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact us at support@moundlab.com.
• We reserve the right to change pricing with 30 days’ notice to existing subscribers.

6. User Conduct

You agree not to:

• Use the Platform for any illegal purpose
• Attempt to reverse-engineer, scrape, or exploit the Platform or its data
• Create multiple accounts to circumvent plan limits
• Misrepresent MoundLab’s virtual results as real financial performance
• Harass, impersonate, or harm other users
• Upload malicious content or interfere with Platform operations

7. Intellectual Property

All MoundLab content, code, design, and branding are owned by MoundLab or its licensors. You retain ownership of the scout names and descriptions you create.

MLB team names, logos, and related marks are trademarks of Major League Baseball and its member clubs. MoundLab is not affiliated with, endorsed by, or sponsored by Major League Baseball, any MLB team, or the MLB Players Association. Statistical data is sourced from publicly available records.

8. Leagues and Social Features

When you create or join a league, your scout name, performance data, and display name are visible to other league members. League creators may share join codes publicly. Public leagues are visible to all users.

9. Odds Data Disclaimer

MoundLab displays publicly available MLB odds and statistical data for informational and analytical purposes only. The display of odds does not constitute gambling advice, an offer, solicitation, or encouragement to place any wager with any sportsbook or gambling operator. MoundLab has no affiliation with any sportsbook or gambling entity. Users must not rely on MoundLab data for real-world wagering decisions.

10. No Guarantee of Results

Past simulated performance does not predict or guarantee future results, either on this platform or in any real-world context. MoundLab’s analytics, predictions, and AI-generated insights are provided for entertainment and educational purposes only.

11. Account Deletion

You may delete your account at any time through the Platform. Upon deletion, all your personal data, scouts, picks, league memberships, and associated records will be permanently removed. This action cannot be undone.

12. Limitation of Liability

MoundLab is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, MoundLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to any real-world decisions made based on Platform information.

13. Indemnification

You agree to indemnify and hold harmless MoundLab, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

14. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

15a. Auto-Renewal Disclosure

Paid subscriptions (Contender and Pro) automatically renew monthly at the then-current rate until canceled. The Season Pass is a one-time payment for the current MLB season and does not auto-renew. You may cancel your subscription at any time from your account settings or by contacting support@moundlab.com.

16. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, and the arbitrator’s decision shall be final and binding.

• Class action waiver: You agree to resolve disputes individually and waive any right to bring or participate in a class action, collective action, or representative proceeding.
• Opt-out: You may opt out of this arbitration agreement by sending written notice to legal@moundlab.com within 30 days of creating your account. Your opt-out notice must include your name, email, and a clear statement that you decline arbitration.
• Small claims exception: Either party may bring an individual action in small claims court in lieu of arbitration if the claim qualifies.
• Exclusive venue: For any disputes not subject to arbitration, the exclusive venue shall be the state or federal courts located in Wilmington, Delaware.
